trump's Refuge in Vulgarity Now Costs him Millions

Lordy, all this not winning from trump when it comes to legal accountability. A second trial involving trump's defamation towards E. Jean Carroll when she came forward with her rape allegations ended with the jury finding major punitive damages against him (via Ximena Bustillo at NPR):

A New York jury on Friday ordered former President Donald Trump to pay a total of $83.3 million to E. Jean Carroll for ruining her credibility as an advice columnist when he called her a liar after she accused him of sexual assault.

The jury awarded Carroll $65 million in punitive damages, $11 million for the damage to her reputation and another $7.3 million. Trump is almost certain to appeal the verdict.

Despite the size of the penalty, the verdict was not unexpected. Judge Lewis Kaplan ruled even before the trial that Trump had in fact defamed Carroll. The jury only had to decide how much Trump owed her — not if he was liable. This is the second time Trump has been ordered pay Carroll; last year he was mandated by a jury to pay $5 million for a separate instance of defamation...

This one is different from the first trial trump faced against Carroll and lost. That matter revolved around her rape allegations directly, which she was able to file under a special law New York had passed to let rape victims confront their attackers in civil court. This matter revolved around trump just being a vicious gaslighting defaming asshole, which Carroll's lawyers were able to prove in court especially as trump kept attacking her AND the judge throughout this particular matter.

It quickly became a question not if the jury would find trump liable, but how much they would set the punishment to see what would work to shut him up. David A. Graham at the Atlantic is curious to see if $83 million-plus at this point would do it:

Although Trump’s fortune is enormous, usually estimated in the billions, he is likely to feel the cost of today’s verdict. First, he is a notorious skinflint—he once cashed a 16-cent check sent to him as a prank by Spy magazine—so any cost, especially one denominated in eight figures, will pain him. Second, much of his net worth is tied up in illiquid assets such as real estate or intangible ones such as brand value. The former president sometimes acts like he has limited cash flow, so coming up with $83 million (if that amount is sustained) might not be simple...

The second defamation case was entirely an own goal by Trump. Having lost the first case, all he really had to do was stop publicly assailing Carroll. He didn’t have to admit that he was wrong. He didn’t have to admit that he had sexually assaulted Carroll. He didn’t even have to admit that he had defamed her. He just had to stay quiet.

But this being Trump, he couldn’t do it...

What had been trump's greatest legal strength - his willingness to bully and harass his legal targets until they surrendered to him and settled for less money and no admission from himself - is now his biggest weakness because he can never shut up. trump can't stop attacking anyone and everyone he perceives are his enemies, and trump can't stop lying like he does when he sells himself as both hero and victim.

And he's now going against legal opponents who either cannot walk away from the fight (like Carroll), or they have the resources both legal and financial to take the fights to the bitter end, like the state of New York going after trump's tax evasion and acts of fraud.

We are all, by the by, waiting for the judge to return the findings in THAT matter any day now. Which should come before the New York criminal trial into trump's hush money payments set for late March. We're still waiting to find out if the federal appellate court will determine if trump has absolute immunity, and if that would allow the DC court case into trump's involvement in January 6th to proceed sometime in March as well (it's looking like it might get delayed until mid-year).

And this is the grifting, law-breaking, vulgar con artist the Republican Party still wants to represent them for the presidency in 2024. Gods help us all.

Georgia Indicts trump and his Big Lie

At last.

Stephen Fowler over at NPR has the basics: 

A grand jury in Georgia has indicted Donald Trump for his role in failed efforts to overturn the state's 2020 election results, implicating the former president as the head of a sweeping conspiracy to subvert his defeat.

It's the fourth indictment in as many months for Trump, the front-runner for the Republican presidential nomination. And it's part of a massive case brought by Fulton County District Attorney Fani Willis under Georgia's racketeering law, ensnaring a number of defendants that the DA alleges acted as part of a coordinated effort to pressure officials to change the election outcome.

In an indictment handed up Monday, an Atlanta-based grand jury outlined a series of charges against Trump, including violation of the Georgia RICO law and solicitation of a violation of an oath by a public officer.

RICO by the by is a racketeering charge, meaning trump and others engaged in a wide-ranging conspiracy to commit multiple crimes. Emptywheel - you know what I need to call her by name, so hello Marcy Wheeler! - has more details on the implications of trump getting hit by RICO:

LIES TO AND SOLICITATION OF GEORGIA OFFICIALS

Count 2 though Count 7: False claims and illegal requests made, many by Rudy Giuliani, before the fake electors scheme. These were lies told to official bodies of Georgia state government, and charging them is an attempt to prevent corruption in state government.

Count 23 through Count 26 charge Rudy, Ray Smith, and Robert Cheely with false claims and solicitations on December 30 — similar in structure and purpose to Counts 2 through 7.

Count 28 charges both Trump and Mark Meadows for the January 2 call to Brad Raffensperger. Count 29 charges Trump for the lies he told during the call.

Counts 38 and 39 charge Trump with lies and solicitations of Brad Raffensperger on September 17, 2021.

FAKE ELECTORS

Count 8 through Count 19: These are a series of six paired charges tied to various kinds of fraud involved with the fake electors. In each pair, the first count charges David Shafer, Shawn Still, and Cathleen Latham for doing the fraudulent thing, and the second count charges Trump, Rudy, John Eastman, Ken Chesebro, Ray Smith, Robert Cheely, and Mike Roman with soliciting the fraudulent thing. They’re a near parallel to the Michigan charges against the fake electors, except that in Georgia only the three most culpable fake electors are charged, and there’s a mirror charge for Trump’s side of the conspiracy.

ATTEMPTS TO ENTRAP RUBY FREEMAN

Counts 20 and 21 and : These charge two efforts to defraud Ruby Freeman by offering her help when in fact they were an attempt to entrap her.

Count 30 and Count 31 charge aspects of a plot to get Kanye’s publicist to travel from Illinois to Georgia to entrap Ruby Freeman into making false claims.

LIES ABOUT GEORGIA

Count 22 charges Jeffrey Clark for his attempts to get DOJ to claim the Georgia election was fraudulent.

Count 27 charges Trump and Eastman with lying about Georgia’s results in a lawsuit.

TAMPERING WITH COFFEE COUNTY TABULATORS

Count 32 through Count 37 charge Sidney Powell, Latham, and two others for tampering with the Coffee County vote tabulators. Again, this has a parallel in the Michigan charges against Matt DePerno and two others.

LIES DURING THE INVESTIGATION

Count 40 charges David Shafer with false statements told during the investigation.

Count 41 charges Robert Cheely with perjury for false claims made during the investigation.

As I understand it, these are the charges on which the RICO conspiracy is built. The RICO conspiracy gives prosecutors additional tools and penalties with which to prosecute this (similar to the conspiracy law charged at the federal level)...

That's a lot of criming (relax, Spellchecker, we can use slang while blogging), but what are the implications surrounding these particular indictments compared to the other three (and counting) trump and cohorts are facing? Why is this one a bigger deal than most?

One of the common elements in the Georgia indictment is the word "lies". Over and over, DA Willis spells out how trump and company lied and kept lying to other state officials in order to get them to violate the integrity of the 2020 election results. They have trump lying in a lawsuit, they have one underling Robert Cheely charged with straight-up perjury to the grand jury, they had people lying to county-level elections official Ruby Freeman to get her to "confess" to rigging ballots.

All of these lies, serving to the Big Lie that trump pushed and keeps pushing about the 2020 results. trump's Big Lie that the election "was stolen" and he "fairly" won.

I blogged about trump's Big Lie before, and why he can't stop:

Trump has made it clear he views the world in the simplest of terms: That people are divided into Winners and Suckers, and that HE (champion and most excellent of the former group) shall never be lumped in with the latter.

So just on this mindset alone, trump cannot admit – not to others, not to himself – that he lost... 

In one respect, trump lost in 2016: The Popular vote clearly went for Hillary. But due to the broken and anti-democratic nature of the Electoral College, trump squeaked into winning three battleground states with literally mere hundreds of votes that gave him their Electoral Votes instead. It should be noted that trump promptly crowed – against all evidence – that he had won a LANDSLIDE, not just the College but also the Popular vote, and claimed it was the greatest victory in history (ignoring the Electoral and Popular vote blowouts of 1984 and 1932 (we don't count Nixon's 1972 blowout because the cheating exposed by the Watergate scandal negates that)).

Trump can't crow like that this time. The illusion of the Electoral College can't grant him that excuse. So he has to settle on denial. Constant, whining denial that he's the victim of voter fraud and to get us to pity him back into office...

The horrifying thing was how easily trump got fellow Republicans to buy into his Big Lie all because the GOP fears the loss of political power:

The Republicans are stuck with the Big Lie because it happens to fit this One Truth:

The Republican Party cannot and will not share power with a Democratic Party they view as un-American and thus illegitimate.

Somewhere back in time - you can argue happening between the rise of the conservative Southern Strategy in the late 1960s or the rise of Saint Ronnie in the 1980s or the corruption of Newt's Contract On America in the 1990s - the Republican Party bought into the idea that only they were true God-fearing God-chosen Gun-worshiping patriots...

But the Republicans have a problem. Where their One Truth was merely a world-view that did not expose itself to self-destructive implosion (Republicans could keep believing it and still function rationally in polite society), the Big Lie is a direct attack on the Real World that sooner rather than later is going to hit the Brick Wall of Unbreakable Facts. The Big Lie compels trump's believers into direct action - SEE the January 6th Insurrection - and these actions have legal consequences where the Big Lie has not and cannot prevail.

The Republicans are betting on their Big Lie carrying them forward into the future. But it's a Big Lie stuck in the past of a failed 2020 election, pushed constantly by a Big Liar in trump who cannot avoid his impending fate either in civil or criminal courts.

With the Georgia indictments, we are at that moment of Truth for the Republican Party as a whole. DA Willis and her team are making a direct rebuke to trump's Big Lie, confronting it with facts and evidence that not only were the voted counted fairly but that trump and his people intentionally worked to subvert those fair counts.

I am paraphrasing Jean-Luc Picard here, in one of the greatest quotes about the quest for justice. Courtrooms are crucibles: In a courtroom we burn away irrelevancies (the lies and misunderstandings) until we are left with a pure product - the truth (based on fact), for all time. For all of trump's bullshitting at his rallies, for all of the deflection and deception by the Far Right media, for all the spineless quibbling of other Republican leaders who fail to hold trump to the factual truth, in a court of law those lies and deceptions cannot withstand scrutiny. trump will confront - at last - the lies he's been telling to everyone and even to himself, and that those lies have no power to keep him in power.

The reason why I remain so optimistic - giddy, even - about the criminal cases leveled against trump is that these courtrooms are going to be the few places where trump will be held accountable for the ongoing costs of destruction and ruin he has built up over the decades. trump's greed, trump's racism, trump's sexism, trump's rage, trump's delusions of grandeur... All of that finally getting added up and presented as a bill way past due that he has to pay.

Let trump face his lies and failures before the 2024 elections. Let the nation come to terms with the reality that trump should never hold any elected office again.

Let justice be done. Let truth prevail. At last.

Where the Grifting Takes the GOP

You follow drugs, you get drug addicts and drug dealers. But you start to follow the money, and you don't know where the fuck it's gonna take you.

In a followup to last week's bombshell that a New York Republican Representative-Elect was a gaslighting fraud, I need to note that the authorities are finally paying attention to George Santos and opening criminal investigations on him. O the irony of grifting your way into elected office letting prosecutors find out you were grifting in the first place.

While the mainstream media is busy assigning blame on who's responsible for Santos getting as far as he has - blaming Democrats for not doing enough Oppo Research, blaming local press for not digging into Santos' bogus resume - the most blame should be aimed at Santos himself for setting himself up for this exposure and ridicule (if not future jail time). After that, most of the blame should be aimed at a Republican Party that is not only vulnerable to con artists buying their way into their ranks, but happily defending the grifters even when their scandals threatens to expose all the other corrupt sins hiding in the GOP closets.

As Jill Dennison notes at her blog:

I could point to so many, such as Marge Greene who was elected to the U.S. House of Representatives despite being a follower of QAnon, despite believing that Jewish space lasers (hint, in case any Republicans are reading this, there ain’t no such thing as Jewish space lasers) started the California wildfires.  Or the pistol-totin’ barhop, Lauren Boebert who proudly put a photo of all her children holding big guns on her Christmas cards.  And then, there’s Kevin McCarthy, vying to be the next Speaker of the House, whose only platform is revenge against any and all liberal democratic policies and those of us who support those policies.  But for now, I want to focus on one incoming member of the House, a person who will be seated in the House of Representatives next Tuesday, a person who has broken the boundaries of dishonesty:  George Santos...

This is a new low even for the Republican Party and if, in fact, they allow him to be seated in the House on Tuesday, it will be the most definitive statement yet that there is no conscience, no morals, no values, and no integrity within the Republican Party.  One lie of any substance would have disqualified any Democratic candidate, but Mr. Santos told lies about every single aspect of his entire 34 years!!!  I imagine there are some Republicans who are wishing they could crawl under a rock right about now – Susan Collins, Lisa Murkowski, Mitt Romney – but the rest seem to be scratching their heads and wondering how to get this out of the news, how to make it disappear.  Not a single word from the otherwise garrulous Kevin McCarthy… funny that.

This is, for the Republicans, as bad a nightmare as the former guy, an egomaniac, planning to run for the Oval Office again.  I would pity the Republicans, but … they brought this mess on themselves when they first began letting unqualified circus clowns run for office.  It seems to me that a person who cannot even be relied upon to tell the truth about where he went to college (he didn’t), property he claims to own (but doesn’t), where he has worked, his ancestry, his criminal past, where he lives, cannot possibly be trusted to be an honest lawmaker!  I thought Herschel Walker told some mighty big lies, but Santos even makes him look like an amateur.  Santos is right up there with the former guy, who wouldn’t recognize the truth if it smacked him upside the head!  This is NOT what this nation needs … lawmakers who cannot ever be trusted, whose words and actions must always, always be fact-checked!  But alas, this is the new GOP – which, by the way, no longer stands for “Grand Old Party”, but rather for “Gaslight Or Perjure...”

Dennison - and others - are calling on the Republican leadership to do the right thing, the ethical thing, but the likes of Kevin McCarthy cannot afford to kick Santos to the curb because their control of the US House is on a precarious - 5-seat margin - footing already. McCarthy himself is facing an unheard-of fight of his life for the Speakership, and he needs all the grifters he can find to save his own ass in this moment. Even though Santos will condemn McCarthy - and the rest of the GOP - down the road.

This scandal with Santos is exposing the reality that the Republican Party for all historic purposes is no longer a political party, it's an ongoing criminal conspiracy. As Amanda Marcotte points out at Salon, entire decades of lusting after power has turned a once-proud Party into a haven for grifters: 

One thing was dead certain within moments of the New York Times publishing its exposé on the many lies of George Santos: There was zero chance that this brand new Republican congressman-elect from New York would be shamed into giving up his seat. Perhaps that didn't seem obvious to everyone at first, especially those with lingering memories of the pre-Trump era, when we all pretended to believe that Republican voters cared about hypocrisy, lying, overt racism, sexual abuse or any of the other personal or professional scandals that used to take politicians down routinely. But I never doubted for a moment that Santos would move onward toward being seated and that the incoming Republican House majority would allow it...

Despite all this, the only way he doesn't join Congress as an esteemed member of the Republican caucus is if New York prosecutors can nail him for something first. I believe this in the way I believe that chocolate is delicious and cats are cute. After all, what is the modern GOP, if not a holding station for every two-bit criminal and grifter who wants the job security that can only come with exploiting the endlessly credulous Republican base? The party can no more start kicking out the fraudsters than it can stop trying to cut taxes for the rich. This is just who they are and what they do. George Santos is in no sense an anomaly. He is the Republican present and, even more to the point, the Republican future...

This is what gets delicately described as "negative partisanship" in mainstream media and political science textbooks, and all too often treated as an equal problem on both sides. Of course it's true that both parties include some voters who are more motivated by dislike of the opposing party than by support for their own. But with Democrats, that at least has some basis in real-world concerns, given that Republicans are the party of abortion bans and the Jan. 6 insurrection. But on the other side, Republican voters mostly coast on hyperbolic vitriol about the evils of Democrats, which are at best vague insinuations of corruption, and at worst outright lies and QAnon-style conspiracy theories. 

Convincing Republican voters to believe that Democrats are literally the worst people imaginable certainly helps Republicans win elections. But it's also destabilizing the party from within, because shady characters of all flavors now understand that no sin or crime is so great that it cannot be wiped away by running for office as a Republican. The result is a party full of cranks, chronic liars and petty criminals, a situation that gets worse every election cycle, as demonstrated by the Santos fiasco...

We still don't know where George Santos got the money that allowed him to run and win a congressional election in a pivotal swing district. But he's still likely to be seated next week with no serious impediment, offering America's swindler class another reason to believe that going into Republican politics is like getting a license to commit fraud. There's no real chance of political backlash in a situation like this, with the GOP voter base heavily dosed up on Fox News hate. Worse yet, it seems increasingly clear that federal law enforcement is too afraid of looking "partisan" to prosecute Republican politicians over anything, so there are no serious legal consequences either. Sam Bankman-Fried may be kicking himself for getting into cryptocurrency instead of GOP politics, if what he wanted was the ability to defraud whoever you like with impunity...

I wrote in 2015 that the Republican Party was dead in spirit, with only a decaying body shambling about going through the motions of politics in order to keep all the money and power in their undead uncaring hands. With the 2016 election of donald trump, the Republicans were stuck with the reality that he paved the way for all the other grifters to yell and scream enough on Far Right media outlets to win offices in safe gerrymandered districts (or safe Red states full of Culture War angst). 

With these political offices in their hands, they can con their way to put more government funds in their own pockets. They can then campaign and fundraise to their hearts' desires, sucking up every last penny from the suckers who buy their vitriol and eat it like caviar. This is the new con game, where the liars can make money even if they lose by declaring themselves victims and fundraising off of that.

This is where the modern GOP is. A party filling up with George Santos and a hundred other grifters. Now literally "trumps all the way down." 

trump can't go to jail for his crimes fast enough. Here's hoping he shares a cell block with Santos sooner rather than later. Along with the other Republican grifters thriving off of fear and hate and greed.
